ATake Announces Markman Ruling in Litigation Favorable to ATake’s customers’ Defenses and Countercla
May 11, 2015 [Shenzhen, China] - - - ATake announced today that District Court Judge Donald M. Middlebrooks of the U.S. District Court for Florida has issued a Markman Order in the litigation brought by Leading Edge Novelty, Inc. and Tsan-Yao, Chen against ATake’s customers. Leading Edge Novelty, Inc., and Tsan-Yao, Chen originally accused ATake’s Customers of infringing U.S. Patent Nos. 7,617,624.
The Court's April 28’s Order interprets the disputed terms in the remaining patents asserted by Leading Edge Novelty, Inc. and Tsan-Yao, Chen. In its Order, the Court adopted ATake’s customers’ (Defendant) position as to the proper interpretation of certain of the key terms in dispute. ATake and its customers believe the interpretations in the Court's Markman Order support the position it has taken throughout this case that it does not infringe Leading Edge Novelty, Inc. and Tsan-Yao Chen’s patent.
ATake has strongly believed since this suit was filed that Leading Edge Novelty, Inc. and Tsan-Yao, Chen allegations are without merit, and that this suit is a result of their unfortunate decision to compete in the courtroom rather than in the marketplace. We believe this ruling supports our customers’ non-infringement positions and their counterclaims in this case and we look forward to obtaining favorable results to that effect.
Leading Edge Novelty, Inc. and Tsan-Yao, Chen filed this suit against ATake’s customers on November 20, 2014 in the U.S. District Court in the District of Florida, asserting infringement of U.S. Patent Nos. 7,617,624. On March 16, 2015, the Court ordered the Early Claim Construction Hearing set for 4/28/2015 09:30 AM in West Palm Beach Division before Judge Donald M. Middlebrooks.
